MICHIGAN LABELS TROUBLED TEENS AS TERORRISTS

AP - Michigan's use of an anti-terrorism law to curb school violence has sparked debate over the law's intent and raised an important question among prosecutors, school officials and others: When is a troubled teen a terrorist? Law enforcement officials say the law against threatening terrorism, enacted in the wake of the 9/11 attacks, gives them a vital tool to avert shootings such as the one last month in Minnesota, where a student shot and killed nine people before turning the gun on himself. With no specific state law against threatening to kill someone, they say, the terrorism law is the only one that works. But many school-violence experts say labeling a disturbed or angry teen a terrorist is going overboard. In some cases, they say, what the student needs is psychological help, not jail time.
We have to "discern between students who pose a threat and students who are making threats," said Glenn Stutzky, a clinical instructor at the Michigan State University School of Social Work. "It appears the terrorism law doesn't make that distinction."

DAN KLEPAL, CINCINATI ENQUIRER - The eight-month undercover investigation at Milford High School by a private detective, hired to pose as a student and infiltrate the school's drug scene, was so secret that school board members didn't even know of the $60,000 expenditure to the Dayton security firm that provided the detective. Only Superintendent John Frye, who came up with the idea, and school board president Carol Ball, who gave her approval, knew of the investigation in which the detective in her 20s posed as an 18-year-old student who went to classes, took exams, and went to after-school parties without anyone - including teachers - knowing her identity. . . The investigation culminated Friday with the arrest of 16 students on drug-trafficking charges. Twelve are juveniles.

DAVID WILLIAMS, EVENING STANDARD - A new "intelligent" speed trap is set to catch thousands of drivers in London. Groups of cameras will track cars over a wide area - such as a housing estate - instead of "flashing" them at just one spot. Designers say it will be impossible for drivers to outwit them by slamming on their brakes as the cameras record each car's number plate and "talk" to each other via radio-wave technology. Computers then calculate how fast the vehicle was traveling between each point.

STEPHEN DYER, AKRON BEACON JOURNAL - There's a one-in-959,000 chance that exit polls could have been so wrong in predicting the outcome of the 2004 presidential election, according to a statistical analysis. Exit polls in the November election showed Sen. John Kerry, D-Mass., winning by 3 percent, but President George W. Bush won the vote count by 2.5 percent.
The explanation for the discrepancy that was offered by the exit polling firm -- that Kerry voters were more likely to participate in the exit polling -- is an "implausible theory,'' according to the report issued Thursday by US Count Votes, a group that claims it's made up of about two dozen statisticians.
Twelve -- including a Case Western Reserve University mathematics instructor -- signed the report. Instead, the data support the idea that "corruption of the vote count occurred more freely in districts that were overwhelmingly Bush strongholds.''. . .
"The hypothesis that the voters' intent was not accurately recorded or counted... needs further investigation,'' it said. . . The statistical analysis shows that the discrepancy between polls and results was especially high in precincts that voted for Bush -- as high as a 10 percent difference.
The report says if the official explanation -- that Bush voters were more shy about filling out exit polls in precincts with more Kerry voters -- is true, then the precincts with large Bush votes should be more accurate, not less accurate as the data indicate.

DAVE, SYSTEM ADMINISTRATOR, FLAG BLACKENED - OK folks, here's the real deal as far as I can share it legally at the moment. Consider it as a press release if you wish and feel free to distribute it for whatever reason you deem necessary.
I'm under court order not to speak about specifics and have my attorney trying to find out what the maximum penalty for disclosure really is. I hate to have to keep my mouth shut in areas where the Gestapo is involved, but I also have to weigh things against the overall security of flag and it's sub-domains and also the well being of my family.
I have been ordered to submit IP info on two separate incidents having to do with sub-domains hosted on flag. Both of these are in regard to claimed or threatened responsibility for acts of propaganda by the deed. Both incidents involve topics which are completely out of line for consideration here at flag and really I can only view them in two ways. Either people are simply ignorant about the murderous history of the FBI, or, as is my belief in one case, they are trying to make flag vulnerable to government intrusion.
At this point let me say, in all honesty and conviction, that if I end up dead by strange means - suicide, overdose, drunk driving accident (I never, ever, ever drink and drive), "accidental" gunshot to the back of the head while sleeping ala Fred Hampton, car jacking, or anything else reasonably suspicious, contact the FBI in Chico, California for more details.
I have called numerous friends nationwide, anarchists and otherwise whose opinions I respect and who I know will be honest and forthwith in their opinions to ask them how I should proceed. The unanimous consensus is that I comply with the wishes of the FBI and provide the IP addresses responsible. The only point of discussion, really, has been whether or not I should reveal the specific information in violation of two court orders. . .
Freedom of speech does not exist, don't try to test it. They will come bust down your door - for real - point a gun to your head and pull the trigger if you refuse to comply.

MICHAEL, SLASHDOT, AUG 31, 2004 - The Justice Department has issued a subpoena seeking IP logs from Calyx, the ISP for nyc.indymedia.org, after individuals posted the names, addresses, and phone numbers of some of the RNC delegates. The subpoena was issued as part of an ongoing investigation of voter intimidation. As reported earlier in this Slashdot article, the Justice Department tried this before. Calyx, represented by the ACLU, responded, claiming that '[t]he only intimidation taking place here is the Secret Service intimidating people who speak out against the government.'

KATHERINE HALEY WILL, WASHINGTON POST - A proposal by the Education Department would force every college and university in America to report all their students' Social Security numbers and other information about each individual -- including credits earned, degree plan, race and ethnicity, and grants and loans received -- to a national databank. The government will record every student, regardless of whether he or she receives federal aid, in the databank.
The government's plan is to track students individually and in full detail as they complete their post-secondary education. The threat to our students' privacy is of grave concern, and the government has not satisfactorily explained why it wants to collect individual information.

FCC PLANS TO INCREASE CENSORSHIP

STEPHEN LABATON, NY TIMES - The television and radio industries are about to come under renewed attack over sex, violence and profanity in their programming, both in Congress and at the Federal Communications Commission. Leading lawmakers and the new leader of the F.C.C. have proposed a broad expansion of indecency rules, which were significantly toughened just last year. They are also looking for significant increases in the size of fines and new procedures that could jeopardize the licenses of stations that repeatedly violate the rules.
Some senior lawmakers, including Senator Ted Stevens, the Alaskan Republican who is the leader of the Commerce Committee, as well as Kevin J. Martin, the new chairman of the commission, have suggested it may be time to extend the indecency and profanity rules to cable and satellite television providers, which now account for viewership in 85 percent of the nation's homes. And organizations opposing what they consider indecent programming have joined forces with consumer groups that have been trying to tighten regulation over the cable industry and force it to offer consumers less expensive packages of fewer stations, known as ala carte services.
Mr. Martin and the senior Democrat on the commission, Michael J. Copps, have consistently been among the most aggressive members of the agency on indecency issues. President Bush is expected shortly to announce the appointment of two new members to the five-person commission. Those appointments will determine whether the views of Mr. Martin and Mr. Copps on indecency issues will prevail at the agency.

FRAN SPIELMAN AND FRANK MAIN - Fleet Management Commissioner Michael Picardi disclosed plans to install cameras on 125 new squad cars scheduled for delivery over the next two months: front-wheel-drive Chevrolet Impalas that will replace the old rear-wheel-drive Ford Crown Victorias. "It makes it safer for the officer. Now, you're filming everything that's going on during a traffic stop, during an arrest," Picardi said.
Picardi said he's even experimenting with a Big Brother bonus for unmarked police cars: a tiny microphone positioned near the windshield so powerful it can pick up conversations on the street. "You could pull into a street corner and, if there's a drug deal going on a half-block away, you can hear what's going on. You could have all the windows shut and the air-conditioning on and you could hear everything going on outside the vehicle," Picardi said.

We would like to explain certain changes in the terms of the Citizenship Agreement for your U.S. citizenship ("Agreement"). Some of the terms in this notice may already be in effect on your account and will not change. Any terms on your account not changed here remain in effect until such time as we ("We") decide they do not. To help you understand the changes in the terms of your Agreement, We explain the most important changes in the Summary of New Terms below. The changes described will take effect for citizenship cycles beginning Jan. 20, 2005, and will apply to all existing and future balances on your account.

SUMMARY OF NEW TERMS

SECTION 5
The Freedom of Speech section of the Agreement is amended to distinguish between Regular Preferred Speech and Non-Preferred Speech. The Non-Preferred Speech rate applies to all speech which is not in good standing as defined under the "Preferred Citizen Rate Eligibility" section of your Agreement. Both the rate and your freedom of speech may vary based on changes in the National Terror Alert Level.

SECTION 9
The Rates and Fees Table, including rates for personal and corporate income tax, estate tax, Social Security tax, and all other Federal taxes, levies, duties, and surcharges, remains unchanged, except that it is to be read while being held up to a mirror. . .

SECTION 13
The Cruel and Unusual Punishment section of the Agreement is unchanged, except that "unusual" is amended to read "unusual in Texas.". . .
