Response from Senator Murray

Dear Mr. Brineman:

Thank you for contacting me to share your views on S. 256, the Bankruptcy Reform
bill. I appreciate hearing from you.

As you may know, S. 256 was passed by the Senate, and was signed into law by the
President in April. I voted against S. 256. Rather than providing balanced
reform, S. 256 places an extraordinary burden on ordinary Americans who have
fallen on hard times – particularly military families and those struggling with
massive medical bills.

During consideration of this bill I supported several amendments that would have
protected Americans who are forced to file for bankruptcy, such as military
families – particularly Guard and Reserve families – who struggle to make ends
meet with often reduced income during their deployment. Individuals who have
fallen victim to identity theft, or predatory lending practices also sometimes
need bankruptcy protection. I am disappointed that the Senate rejected
amendments to protect past-due child support payments, or to ensure that those
who commit violent crimes cannot avoid their debts and fines by declaring
bankruptcy.

In the past I have voted for bankruptcy reform legislation. But S. 256 goes too
far in punishing families that find themselves in a much different place
financially, because of the costs of healthcare and military service

I will continue to work to support legislation that protects hardworking
Americans. Again, I appreciate your taking the time to write to me on this
